法律術語 原告 plaintiff 在民事方面，以自己的名義提起訴訟，請求法院保護其權益，因而使訴訟成立的人。人民法院在審理民事案件的過程中，對不符合條件的當事人，即與本案沒有直接利害關系，不具備起訴條件，或其民事權益并未受到侵犯、發生爭議，法院應當及時讓這種不符合條件的原告退出訴訟。如果不符合條件的原告不愿意退出訴訟， 應當以裁定駁回起訴；如果其他當事人中有符合條件的原告而不愿參加訴訟，可以終結案件的審理。
